Items legal in the State of New York are: sparklers, ground base sparkling devices - Fountains with up to max amount of 500 grams of pyrotechnic charge, novelties - smokes, snaps, snakes, poppers.  In NY each county regulates the sale and use of these items - more information below

You must be 18 years old or older to purchase fireworks in NY 

With exception of NYC, where all fireworks are illegal ---   Anyone over 18 can purchase and have NY legal fireworks - no matter what county you live in.  HOWEVER,  you can only discharge those fireworks in a legal county.   Fireworks can also be used all year in NY legal counties.

The sale of this type of firework - sparkling devices is regulated by NYS OFPC  (office of fire prevention and control) which falls under NYS Department of Homeland Security.   There are 2 selling seasons in NY  summer and winter around New Years -  Again fireworks can be legally used all year only selling seasons and vendors are regulated.  Each vendor needs to obtain a permit from NYS OFPC.  Any one selling without such permit is in violation of NYS Penal Law 270 / 405
